Terms of Verification

Scope. The Bank performs a documentary examination of the files submitted. It addresses the authenticity of the documents as presented, their internal and external plausibility, and their sufficiency for the purpose stated above. The examination is documentary. It is not an audit, not a legal opinion, and not confirmation with any issuing or holding institution.

Confidentiality. The Bank and the submitter each undertake to keep confidential the documents submitted, the written report, and the fact of the submission, and not to disclose them to any third party save as set out below. This undertaking is mutual and runs for five years from the date of the report.

Permitted disclosure. The undertaking does not restrict disclosure where required by law, regulation, court order or supervisory authority; to the Bank’s regulators, auditors and professional advisers; where the Bank is subject to reporting obligations under applicable anti-money-laundering or counter-terrorist-financing rules; or of information already in the public domain or lawfully held before submission.

Authority to verify at source. Level 1 is a documentary examination and the Bank does not contact issuers as part of it. The submitter nonetheless authorises the Bank, should it choose to do so, to approach the purported issuer, signatory or registry of any submitted document for the sole purpose of establishing whether that document is genuine, and confirms that it holds the rights necessary to give that authority.

Fee and retention. The review fee is flat and non-refundable and is payable whatever the outcome. Documents and reports of paying submitters are retained for the Bank’s compliance records. Files from submissions that are not completed are not retained.

No offer of finance. A completed verification is not an offer of finance, a commitment, an approval, or a recommendation to act.

Submitter’s warranty. The submitter warrants that the documents are submitted lawfully and that any personal data they contain may be processed for the purpose of the examination.
